After a prolonged legal battle lasting over a decade, Nintendo has triumphed in a patent infringement lawsuit concerning its iconic Wii Remote. The case has revolved around unauthorized controllers produced by Bigben Interactive, now known as Nacon.
The recent ruling in Nintendo’s favor concludes a 15-year dispute, resulting in a $7 million judgment (approximately $8.2 million). This amount includes both the damages awarded and accumulated interest due to the lengthy duration of the case. While Nintendo has secured this victory, the saga continues as Nacon is appealing the decision, further postponing any payment.
Long Road to Victory
The legal proceedings began in 2010 when Nintendo claimed that Nacon’s third-party Wii controller violated its patents and negatively impacted sales of the official Wii Remote. Initially, a court decision in 2011 supported Nintendo’s argument. However, Nacon strategically delayed the final determination of damages until now, keeping the matter unresolved.
Bigben contended that consumers had choices beyond Nintendo’s products, suggesting that Nintendo couldn’t definitively prove lost sales. Nevertheless, the court ultimately sided with Nintendo, affirming the strength of its patents and ruling that any third-party controller would likely infringe those patents.
